Law firm Campbell Johnston Clark (CJC) has hailed a UK court ruling that could prove important for owners whose cargoes arrive damaged.

A UK court of appeal has overturned a first instance judgement that held Chilean line CSAV liable for condensation suffered by Colombian coffee beans carried to Germany for Volcafe.

CJC said the decision clarifies the “order of proof” under the Hague Rules, which contain both duties on the carrier to properly load and handle cargo - and certain defences or “immunities”.
