Claimants swarm Flaminia

Lawsuits against the disabled MSC containership Flaminia are starting to stack up in the Southern District of New York.

Eagle Paper International, which claims to have cargo that may have been damaged or destroyed by a fire that broke out on board the 6,732–teu vessel nearly two months ago, is attempting to attach the assets of the owner and operators.

The plaintiff is seeking $45,000 in damages to cover its missing liner board cargo but observers from the legal arena expect the figure to rise since the company is contesting salvage claims and general average expenses.

The case is similar to one filed by another cargo owner, Trouw Nutrition USA, in late August. Both landed in the same district and target the same defendants- Mediterranean Shipping Co, NSB Niederelbe and a Conti Reederei KG scheme.

Unlike most maritime cases, neither initial complaint can be accessed through the US court’s electronic document filing system but are public record and available to those willing to make the journey to the Southern District.
