The second circuit appeals court said the government of Spain could not pursue its $1bn claim against the company as it did not provide evidence that it was reckless when it certified the tanker as seaworthy, according to the Law360 website.
Prestige sank off Spain's northwest coast in November 2002 after suffering a major structural failure, sending 64,000 tonnes of oil on to the country’s beaches.
