That is the question at the centre of a legal fight between US grain player Archer Daniels Midland (ADM) and an entity affiliated with bankrupt Rhode Island shipowner B+H Ocean Carriers.
ADM has asked a US federal judge in New York to throw out an arbitration award against it in a $5.35m fight, arguing that the deal, alleged to have been made in September 2008, at the height of the shipping market crash, was never signed and that only the October transaction was a true agreement.
