In a unanimous decision by a three-judge panel, Justice Marc Nadon wrote that once the 180,310-dwt Cape Apricot (built 2004) was arrested following its collision with a coal pier, Canadian law does not allow any other arrests of vessels owned by Tokei affiliate Leo Ocean.

While Canadian law allows arrests of sisterships if the offending vessel is not available, it does not allow seizure of multiple ships, the court ruled.
