A US appeals court has ordered a federal judge in Texas to throw out a lawsuit against Lloyd’s Register (LR) alleging fraudulent classification.

In a divided decision, a three-judge panel in New Orleans ruled that District Judge David Hittner was incorrect when he rejected the UK classification society’s argument that the suit by US cruiseship owner Pearl Seas Cruises should have been filed in the UK rather than the federal court in Houston.
