Baltic Exchange chief executive Mark Jackson admitted it will be difficult to police the exchange’s new policy, requiring end users of the exchange to have a data licence when indices are referenced in contracts — but has an ace up its sleeve.

Jackson, speaking at a briefing in Singapore last Friday, said that any unlicensed data used in arbitration or other legal proceedings would be deemed invalid for determining damages.
