The thumbs up by Magistrate Judge Andrew Peck will require a decision by a higher ranking jurist – District Judge Lewis Kaplan – to become effective but it appears this time the NYK Line reefer operating subsidiary may actually collect on at least some of the cash it has been hunting.
Peck has recommended that some $1.38m seized in the lawsuit from New York’s Redi Fresh Produce, which has a deal to market and distribute Noboa’s Bonita-brand bananas, be delivered to NYKCool in partial satisfaction of the anticipated judgement.
