The decision by Houston Judge Keith Ellison comes more than 10 months after a jury awarded WesternGeco a nearly $106m verdict in the intellectual property case over ION’s DigiFIN streamer controls.
WesternGeco, a division of oil services giant Schlumberger, won $93.4m for lost profits and $12.5m in royalties, although a final judgement has not been issued.
The company had sought to treble the jury award because ION’s alleged willful infringement of the patents.
