Transformer manufacturer SGB-SMIT has lodged an appeal after a judge threw out its cargo damage lawsuit against multipurpose ship operator Onego Shipping & Chartering and others.

Royal SMIT Transformers and its insurers lodged the challenge with the US Fifth Circuit Court of Appeals.

The move follows a decision by US District Judge Lance Africk of the federal court in New Orleans, Louisiana, who ruled that Netherlands-based Onego and two overland transport providers were protected by the so-called Himalaya Clause in Royal SMIT’s contract with projects and general cargo logistics firm Central Oceans.
