Essberger and Marubeni poised to clash in trial over tanker demurrage

German tanker owner John T Essberger is set for a London trial in a row over a demurrage claim.

Peter Macdonald Eggers QC, sitting as a deputy judge of the High Court in London, refused an application from charterer Marubeni for summary judgment in a dispute over the filing of claim documents.

The ruling is seen to demonstrate that UK courts will apply common sense in cases where documents have been filed at different times but are obviously part of the same claim.
