A Canadian federal judge has rejected a bid by an affiliate of Tokei Kaiun to shift liability to a local pilot in the court fight over a bulker crash in December 2012.

Justice Elizabeth Heneghan has ruled that pilot Captain Jeffrey McDonald — who was at the helm of Tokei Kaiun’s 180,310-dwt Cape Apricot (built 2004) when it smashed into a Westshore Terminals coal pier near Vancouver — was a licensed pilot at the time of the incident and therefore protected by liability limitations.
