Last year’s High Court legal battle, between Gard and the International Oil Pollution Compensation (IOPC) Funds, over the spill exposed a potential fault in the legal immunity the latter has been granted by the UK government.
London High Court judge Justice Hamblen rejected an IOPC Funds contention that it enjoyed a general legal immunity, apart from specified exemptions, and instead ruled that there was only qualified immunity.
